How Rocky Mountain Metal collects, uses, and protects your information, including your cookie choices and your right to opt out of the sale or sharing of personal information.

Privacy Policy Last updated October 15, 2026

This Privacy Policy explains how Rocky Mountain Structures LLC, doing business as Rocky Mountain Metal (the "Company," "we," "us," or "our") collects, uses, discloses, and protects information about you when you visit rockymountainmetal.com (the "Site"), contact us, request a quote, or otherwise interact with us (collectively, the "Services"). We are a dealer and contractor for steel-framed metal buildings from 1st Choice Metal Buildings and Carports, based in Penrose, Colorado, serving property owners across Colorado.

Plain-Language Summary

Here's the short version. The full policy below controls if there's ever a conflict.

  • What we collect: Your contact details when you reach out (name, email, phone), what you tell us about your project, basic device/usage data when you browse the Site, and, if we offer call recording or chat, those records.
  • Why we collect it: To answer you, quote and schedule your build, run and improve the Site, keep things secure, and meet legal obligations.
  • We don't sell your information for money, and we don't send marketing spam.
  • Texting is opt-in. We only text you if you ask us to or give us your number for that purpose. Reply STOP to cancel, HELP for help. Message and data rates may apply.
  • Cookies & advertising: The Site uses cookies it needs to work, Google reCAPTCHA on its forms, and the Google Ads tag, which helps us see whether our ads lead to quote requests. In the U.S. the advertising cookies are on unless you turn them off: use the Cookie Settings link at the bottom of any page, or turn on Global Privacy Control (GPC) in your browser and we turn advertising off for you automatically. Visitors in the European Economic Area, the United Kingdom, and Switzerland are asked first, and advertising and analytics cookies stay off unless they accept. See Your Privacy Choices.
  • Your choices: Depending on where you live (for example, Colorado or California), you may have rights to access, correct, or delete your information. See Your Privacy Choices and "Your Privacy Rights" below, or contact us at (719) 285-3640 or choicebuildingsusa@gmail.com.
  • Kids: Our Services are for adults; we don't knowingly collect information from children under 13.

1. Information We Collect

We collect the following categories of information. Not every category applies to every visitor; what we collect depends on how you use the Services.

1.1 Information you give us directly

  • Identifiers and contact information: name, email address, telephone number, mailing or project address, and similar identifiers you provide through our contact, quote, or other forms.
  • Project information: the type of building you want (e.g., metal carport, detached or metal garage, workshop, RV storage building, small warehouse, or agricultural building), project location, size, intended use, timeline, budget range, and any details you choose to share.
  • Employment information (only if we accept job applications through the Site): the information in your application, work history, qualifications, and any résumé or message you submit.
  • Communications: the contents of emails, form submissions, text messages, chat messages, and other messages you send us, plus any attachments.

1.2 Information we collect automatically when you use the Site

  • Usage and advertising measurement data (collected by the Google Ads tag, see Section 7): pages viewed, the ad click or referring page that brought you to the Site, whether you sent a quote request, approximate location derived from IP address, date/time stamps, and cookie or device identifiers.
  • Device and connection data: IP address, browser type and version, operating system, device type, screen size, language settings, and similar technical information.
  • Cookies and similar technologies: see Section 7 (Cookies, Tracking & Analytics).

1.3 Information from calls, chats, and forms

  • Call tracking and call recordings: If we use a call-tracking service (to measure which marketing efforts drive calls and to improve customer service), the following applies. Calls to or from numbers associated with our Services may be recorded or monitored for quality, training, and record-keeping. Colorado is a one-party-consent state for call recording; by continuing a call after any recording notice, you consent to recording.
  • Chat transcripts: If we offer a chat or messaging feature, we (and our chat provider) may store transcripts of those conversations.
  • Form submissions and anti-spam: Forms on the Site are processed through our website platform provider's secure form service, and we use a bot-protection service (Google reCAPTCHA) to reduce spam and abuse. Your use of reCAPTCHA is subject to Google's Privacy Policy and Terms of Service.

1.4 Information from third parties

  • Service providers and advertising/analytics partners that help us run the Services (see Section 4).
  • Publicly available sources and lead/referral sources, where you have engaged us through them.
  • Social media platforms, if you interact with our profiles or content.

2. Sources of Information

We collect information from: (a) you, directly, when you contact us or submit a form, call, text, or chat; (b) automatically, through your device and browser as you use the Site (cookies, analytics, server logs); and (c) third parties, such as our website, hosting, and form-processing providers and, where used, analytics, call-tracking, and advertising providers, and referral or lead sources.

3. How We Use Your Information

We use the information we collect to:

  • Respond to your inquiries and provide quotes, estimates, consultations, and customer service;
  • Plan, order, schedule, oversee, and follow up on building projects and related services;
  • Process and evaluate job applications, if we accept them;
  • Operate, maintain, secure, personalize, and improve the Site and our Services;
  • Communicate with you about your project, appointments, and requests, including by phone, email, and, where you've opted in, text message;
  • Send you information, updates, promotions, or offers you've asked for, and let you opt out at any time;
  • Measure and improve our marketing and understand how visitors find and use the Site;
  • Detect, prevent, and address fraud, abuse, security incidents, and technical issues;
  • Establish, exercise, or defend legal claims; and
  • Comply with applicable laws, regulations, and legal process.

We do not use your information for automated decision-making that produces legal or similarly significant effects about you.

4. How We Disclose Your Information

We do not sell your personal information for money, and we do not send or allow others to send you marketing spam using information you give us. We disclose information only as described here:

  • Service providers / processors (by category): companies that perform services for us under contract and may process your information only on our behalf, including:
    • Website hosting, deployment, and content-management providers (our website platform vendor, CI Web Group, and its infrastructure providers, who process Site form submissions through a secure form-relay service);
    • Advertising measurement (Google Ads, operated by Google LLC, which receives cookie and device identifiers, IP address, and page and ad-click details so we can measure whether our ads lead to quote requests; see Section 5 and Section 7);
    • Maps (Google Maps, embedded on our Contact page, which receives your IP address and browser details when that page loads);
    • Communications providers (phone, email, and, only if you opt in, text messaging);
    • Bot-protection / security providers (Google reCAPTCHA);
    • Financing partners, if you ask us about or apply for financing (see Section 4.1);
    • Email and productivity providers we use to communicate with you;
    • Professional advisors (lawyers, accountants, insurers) as reasonably needed.
  • Manufacturer and project partners: 1st Choice Metal Buildings and Carports (the manufacturer that makes and installs your building, using its own installation crew), plus suppliers, engineers, or permitting authorities, only as needed to plan, quote, order, permit, deliver, or install your project.
  • Legal and safety: when we believe disclosure is necessary to comply with the law, a subpoena, or legal process; to enforce our agreements; or to protect the rights, property, or safety of the Company, our customers, or others.
  • Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of assets, your information may be transferred as part of that transaction, subject to this Policy.
  • With your direction or consent: any other disclosure you authorize.

4.1 Financing

If you request information about or apply for financing, we may share the information you provide with a third-party financing partner so they can evaluate your request. We currently offer rent-to-own through RTO National, financing through Heartland, and 90-days-same-as-cash. Financing is subject to credit approval through our financing partner, and that partner's own privacy policy and terms will govern their handling of your information.

5. Your Privacy Choices

This section tells you what we collect, who we share it with, and how to turn sharing off. It is written for California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"), and the same choices work for everyone, wherever you live. Colorado residents have matching opt-out rights under the Colorado Privacy Act (Section 6.1).

Your California Privacy Rights: Do Not Sell or Share My Personal Information

Categories of personal information we collected in the last 12 months:

  • Identifiers and contact details you give us on our quote form or by phone or email: name, email address, phone number, and project city or address. Source: you.
  • Project and commercial information: the building you are interested in, size, use, timeline, and anything else you tell us. Source: you.
  • Internet or network activity: pages viewed, the ad click or referring page that brought you here, whether you sent a quote request, and cookie or device identifiers. Sources: the Google Ads tag, Google reCAPTCHA (bot protection on our forms), and the Google Maps embed on our Contact page.
  • Approximate location derived from your IP address. Sources: the same Google tools.

We do not collect sensitive personal information for the purpose of inferring characteristics about you. We do not use Google Analytics, call-tracking, or chat tools on this Site today. If that changes, we will update this Policy first.

Sale and sharing: We do not sell your personal information for money. When the Google Ads tag runs, Google LLC receives internet activity information and online identifiers so we can measure whether our ads lead to quote requests. Under the CCPA/CPRA this may count as "sharing" personal information for cross-context behavioral advertising, and under Colorado law it may count as targeted advertising. The categories involved are identifiers (online identifiers such as cookie IDs and IP address) and internet or network activity. We do not knowingly sell or share the personal information of consumers under 16.

Your right to opt out: You have the right to tell us not to sell or share your personal information. You can do it any of these ways:

  • On this Site: click Cookie Settings at the bottom of any page and choose Decline. This turns off advertising and analytics cookies for that browser and clears Google Ads click cookies already set. Your choice is saved in your browser and applied every time you come back.
  • Global Privacy Control (GPC): if your browser or extension sends a GPC signal, we treat it as a request to opt out of sale and sharing for that browser. Advertising is turned off automatically, with no click needed.
  • Contact us: call (719) 285-3640 or email choicebuildingsusa@gmail.com and ask us to opt you out.

Your rights to know, delete, and correct: You may ask us what personal information we have about you, ask us to delete it, or ask us to correct it, as described in Section 6.2. Send requests using the contact methods in Section 6.3. You may use an authorized agent.

Non-discrimination: We will not deny you service, charge you a different price, or give you a different level of service because you used any of these rights.

Business contact: Rocky Mountain Structures LLC, doing business as Rocky Mountain Metal, Penrose, CO 81240. Phone (719) 285-3640. Email choicebuildingsusa@gmail.com.

6. Your Privacy Rights

Depending on where you live, you may have some or all of the rights below. We extend the core of these rights to all customers as a matter of practice, regardless of state.

6.1 Colorado residents (Colorado Privacy Act, "CPA")

Because we are based in and serve Colorado, we want Colorado consumers to know their rights under the Colorado Privacy Act. Subject to the CPA's conditions and exceptions, you have the right to:

  • Access / know what personal data we process about you;
  • Correct inaccuracies in your personal data;
  • Delete personal data we hold about you;
  • Obtain a portable copy of personal data you provided to us; and
  • Opt out of the processing of your personal data for purposes of (i) targeted advertising, (ii) the sale of personal data, or (iii) certain profiling.

You may also appeal a refusal to act on your request (see Section 6.4). Colorado consumers may use a universal opt-out mechanism (such as GPC) to opt out of targeted advertising and sale; we honor recognized signals as described in Section 7.

6.2 California residents (CCPA/CPRA)

Subject to the CCPA/CPRA's conditions and exceptions, you have the right to:

  • Know / access the categories and specific pieces of personal information we collected, the sources, the business purposes, and the categories of third parties to whom we disclosed it;
  • Delete personal information we collected from you;
  • Correct inaccurate personal information;
  • Opt out of any "sale" or "sharing" of personal information (see Your Privacy Choices);
  • Limit use of sensitive personal information (we do not use it beyond permitted purposes); and
  • Be free from discrimination for exercising your rights.

6.3 How to exercise your rights

Submit a request by:

  • Phone: (719) 285-3640
  • Email: choicebuildingsusa@gmail.com
  • Mail: Rocky Mountain Structures LLC, dba Rocky Mountain Metal, Penrose, CO 81240

We will verify your request using the information we have on file (for example, by matching your name, email, phone, or project details). You may use an authorized agent to submit a request on your behalf; we may require proof of authorization and verification of your identity.

6.4 Response timing and appeals

We will respond to verifiable requests within the time required by applicable law (generally 45 days, with the ability to extend where permitted). If we decline to act, we will tell you why. Colorado consumers may appeal by replying to our decision or contacting us using the methods above; if we deny your appeal, we will provide information on how to contact the Colorado Attorney General with a complaint.

6.5 Other states

Residents of other states with comprehensive privacy laws may have similar rights (such as access, correction, deletion, portability, and opt-out of targeted advertising or sale). Contact us using the methods above and we will honor rights that apply to you.

7. Cookies, Tracking & Analytics

7.1 What we use

The Site uses cookies and similar technologies (pixels, tags, local storage, and SDKs) to:

  • make the Site work and remember your preferences (strictly necessary and functional);
  • protect our forms from spam with Google reCAPTCHA (security); and
  • measure whether our Google ads lead to quote requests with the Google Ads tag (advertising). The Google Ads tag runs only on rockymountainmetal.com.

We do not currently use Google Analytics or other analytics tools on the Site. The Google Maps map on our Contact page may set its own cookies when that page loads.

  • We use Google Consent Mode, so Google tags follow the choice you make in our cookie notice.
  • How our cookie notice works: In the United States the Site uses an opt-out model. Advertising cookies are on unless you turn them off. A notice at the bottom of the page lets you Accept or Decline, and you can change your mind at any time with the Cookie Settings link in the site footer. Your choice is saved in your browser and applied each time you visit.
  • Visitors in the EEA, the UK, and Switzerland: advertising and analytics cookies stay off unless you accept them in the cookie notice.
  • Browser controls: Most browsers let you block or delete cookies. Blocking some cookies may affect how the Site works.
  • Global Privacy Control (GPC) / Do Not Track (DNT): We honor GPC as an opt-out of sale, sharing, and targeted advertising. When your browser sends it, the Site turns advertising cookies off automatically, even if you clicked Accept. Because there is no common industry standard for DNT, the Site may not respond to DNT signals, but GPC is honored where applicable.

7.3 Other advertising opt-outs

By providing your mobile number and opting in (for example, by checking the optional text-message box on our quote form or by texting us first), you agree to receive text messages from us related to your inquiry, quote, scheduling, project updates, and, if you separately opt in, promotions. Consent to receive marketing texts is not a condition of any purchase or service.

  • Programs / message types: quote and appointment coordination, project/service updates, and (with separate opt-in) occasional promotions.
  • Message frequency: message frequency varies based on your interaction with us.
  • Costs: Message and data rates may apply. Check with your mobile carrier for details.
  • Opt out: reply STOP to any message to unsubscribe. You'll receive one confirmation message and then no further texts unless you opt back in.
  • Help: reply HELP for help, or contact us at (719) 285-3640 or choicebuildingsusa@gmail.com.
  • Carriers: Carriers are not liable for delayed or undelivered messages.
  • Eligibility: you represent that you are the account holder or have authority to consent for the mobile number you provide, and that you are at least 18 years old.
  • Privacy of mobile data: We do not sell or share mobile opt-in information or phone numbers with third parties or affiliates for their own marketing purposes. Text-message consent and phone numbers collected for texting are used only to deliver the messages you asked for and to provide our Services. (This commitment is required for A2P 10DLC messaging registration and must remain accurate.)

Our messaging program is operated in accordance with the Telephone Consumer Protection Act (TCPA) and applicable carrier (A2P 10DLC) requirements.

9. Children's Privacy (COPPA)

The Services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us personal information, contact us and we will delete it. We do not knowingly sell or share the personal information of consumers under 16.

10. Data Retention

We keep personal information only for as long as reasonably necessary for the purposes described in this Policy, for example, to respond to your inquiry, perform and document a project, run our business, and comply with legal, tax, accounting, warranty, and dispute-resolution obligations, after which we delete or de-identify it. Retention periods vary by data type and context (for example, project and financial records are typically kept longer than general website analytics).

11. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure (for example, encrypted connections on the Site and access controls on our systems). However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security. You provide information to us at your own risk, and you are responsible for keeping any credentials you use confidential.

11.1 Payment Security

We do not take card payments on this Site, and no page on the Site asks for a card number. Deposits and payments for a building are handled under your signed Build Agreement, outside the website. Financing and rent-to-own applications are completed on our partners' own secure websites (Heartland and RTO National), and their privacy policies and security practices apply there. Please never send card numbers, bank details, or Social Security numbers through our web forms, by text, or by email.

The Site may link to or embed third-party websites, tools, or services (for example, financing applications, maps, social media, video, or review platforms). We are not responsible for the privacy practices or content of those third parties. Their use of your information is governed by their privacy policies, not this one. We encourage you to review them.

13. Out-of-State / U.S. Processing

We operate in the United States and process information here. If you access the Services from outside the U.S., you understand your information will be processed in the U.S., where data-protection laws may differ from those in your location.

14. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date above and post the new version on the Site. Material changes may be communicated through a notice on the Site. Your continued use of the Services after an update means you accept the revised Policy.
